According to TMZ, Kelly's legal team is arguing herpes does not fall under the umbrella of STDs -- like syphilis or gonorrhea -- based on how the term has been defined by the New York State Dept. of Health and the World Health Organization.

Between this, the criminal trial in Chicago, and the newer case about him allegedly grooming and molesting a minor he met in McDonald's, he has bigger things to worry about besides this technicality.
